The terms and conditions apply to any product or service sold on this website. The agreement is between ‘consultant’ Eleen Zirks - Relocation Consulting and the ‘client’ or 'customer'.

Disclaimer

The consultant does not intend to provide legal, tax, financial or accounting advice. In no event shall the consultant be liable for any damages for any indirect, consequential, or special damages. The consultant makes no guarantees, representations or warranties of any kind or nature, express or implied, with respect to the consulting services negotiated, agreed upon and rendered. The consulting program and website site are continually under development, and there is no warranty made of any kind, implied or express, as to its accuracy, completeness, or appropriateness for any purpose. The information contained in this consulting program (including but not limited to content in any format) is based on sources and information reasonably believed to be accurate as of the time it was recorded or created. The materials deal with topics that are constantly changing and are subject to legal and related compliance issues. Therefore, the completeness and current accuracy cannot be guaranteed. It is the clients responsibility to evaluate the accuracy, completeness or usefulness of any information, opinion, advice, or other content contained in the consulting program, program materials or site. The client will seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice, or other content. If any of the parts of this terms & conditions become invalidate of nullified, it does not influence the efficacy of the other regulations. Besides that, legal requirements apply.

1:1 Consulting Sessions

Program content

The client engages the consultant to help and support the client when moving and/or settling abroad. The program content will be discussed individually with the client and stated in a ‘Consulting Client Agreement’. It is understood that consulting differs from coaching and any type of therapy, even though some aspects of coaching might be incorporated into the program.

Appointments

It is the client’s responsibility to schedule sessions. A link to do that online, will be provided upon signing the consulting client agreement. When the client is late for a session, the session will end at the scheduled time. Sessions are booked on a first come, first serve basis and 24 hours of notice are required for cancelling or rescheduling. If the session is cancelled with less than 24 hours’ notice, it will be considered as if it was used. As emergencies can happen to both, client, and consultant, they agree to inform the other contracting partner as soon as possible about the situation. Events such as family emergency, serious accidents or illness are considered ‘emergencies.

Confidentiality

The consultation follows the European General Data Protection Regulation (GDPR). The client’s identity and all means of communication between client and consultant will be held confidential, to the extent permitted by law, unless the client gives the consultant express permission to disclose specific information and vice versa.

Intellectual Property

All materials that have been or will be made available by the consultant connected to the consulting program, whether oral or written, are for the client’s personal use only in, or in conjunction with the consulting program. The consulting program content is for personal use only, and may not be sold, recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent by the consultant. The client understands and agrees that any violation of the consulting policies regarding content shall result in the immediate termination of the consulting without refund.

Payment and Guaranty

Pricing details will be discussed separately and are found in the consulting client contract.

Invoices have to be paid within 14 days. After 14 days, an overdue notice will be send by e-mail by the consultant. After 30 days the consulting service will be terminated until the client catches up with the payments.

The client has 3 days after signing the consulting client agreement to claim a full refund and after 3 days, the administrative fee is non-refundable. The client has 14 days after the program start to cancel or withdraw from the program. If the client had any consulting session until then, that session is non-refundable. The payment is done via PayPal. Via PayPal it is possible to pay by credit card. All prices are in Euro (€), additional exchange rates might apply. The prices include the legal value added tax (VAT) of 19%.

Termination

This program is sold as a package. The termination or extension of the current agreement will be discussed in the penultimate consulting session. The agreement can terminate if the invoices are not paid. The agreement can terminate, if the client behaves in a disrespectful manner to the consultant or violates the confidentiality stated in consulting client agreement or breach any other provision of the consulting client agreement.

Online Courses

Course content and course termination

The consultant provides information regarding applying for a work visa in another country. The information are provided in a 5-week online course, including several videos per week. These videos will be sent weekly by email to the customer. The course is strictly available online. The contract starts with the payment and terminates when the last course module is sent out. The customer agrees to be contacted afterwards to be asked to leave feedback.

The customer understands and agrees that any violation of the consulting policies regarding content shall result in the immediate loss of access to the online course without refund.

Payment and Guaranty

The price of the course can be found on the course sign-up website. The payment is done via PayPal, no PayPal account is required for the payment process. Via PayPal it is possible to pay by credit card. All prices are in Euro (€), additional exchange rates might apply. The prices include the legal value added tax (VAT) of 19%. Full refund can be requested within 10 days pf payment. The access to further modules of the course will then be denied. Unless a refund is requested, the customer has life-time access to the course content (as long as the course exists), added bonuses and updates. When the course is moved to a new platform, the access remains.

Customers Responsibility

It’s the customers responsibility to verify the information provided in the course before taking action upon them. The customers results are unrelated to the content of the course. How fast the customer moves towards the desired goals is related to the amount of own effort put into the transformation. If action is taken based on the course content, the customer takes responsibility for the results. While the consultant is convinced that the customers will derive great benefits and success from the course, no guarantee of a certain level of success can be given. The costs of the course are an investment by the customer. The online course doesn’t intend to provide legal, tax or financial advice.

This way of communication is meant for questions related to the course. If detailed information are asked for that require intensive research time by the consultant, a note will be given to discuss further 1:1 consultation.

Die Allgemeinen Geschäftsbedingungen (AGB) gelten für die auf dieser Internetseite angebotenen Produkte und Dienstleistungen. Die Internetseite wird betrieben von ‚Eleen Zirks – Relocation Consulting‘ (nachfolgend ‚Beraterin‘ genannt). Die AGB gelten für Verträge zwischen der Beraterin und Kund*innen. Beide Vertragsparteien vereinbaren, die darin enthaltenen Leistungen zu erbringen, sowie Rechte und Pflichten einzuhalten.

Haftungsausschluss

Die Beraterin beabsichtig nicht, rechtlichen, steuerlichen, finanziellen oder buchhalterrische Ratschläge zu geben. In keiner Situation ist die Beraterin verantwortlich für jede Art von Schaden welcher direkt oder indirekt im Zusammenhang mit der Beratung stehen. Die Beraterin gibt keine Garantie oder Gewährleistung jeglicher Art für den Erfolg der Beratung und kann incht dafür verantworlich gemacht werden, wenn die Ziele nicht erreicht werden.

Die Beratung und die Internetseite unterliegen ständiger Anpassung und Entwicklung. Es gibt keine Gewährleistung auf Genauigkeit, Vollständigkeit oder Angemessenheit jeglicher Art. Die Informationen in der Beratung (einschließlich aber nicht limitiert darauf) basieren auf Quellen und Informationen die zum Zeitpunkt der Aufnahme oder Erstellung richtig erschienen. Die Materialien beinhalten Themen die sich ständig ändern und Gesetzen unterliegen. Daher kann die Vollständigkeit und aktuelle Korrektheit nicht garantiert werden. Es ist die Verantwortung der Kund*in die Genauigkeit, Vollständigkeit und Brauchbarkkeit der Informationen, Meinungen und Ratschläge und Anderem der Beratung, des Materials oder Internetseite zu prüfen. Die Kund*in wird nach Bedarf angemessene proffessionelle Beratung in Anspruch nehmen um den Wahreitsgehalt zu prüfen.

Sollten einzelne Bestimmungen dieser AGB unwirksam oder nichtig sein oder werden, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt. Im Übrigen gelten die gesetzlichen Vorschriften.

1:1 Beratungsstunden

Programminhalt

Die Kund*in engagiert die Beraterin für Hilfe und Unterstützung beim Umzug in ein anderes Land. Der genaue Programminhalt ist individuell abgestimmt und steht im 'Consulting Client Agreement'.

Kundenverantwortung

Es ist die Verantwortung der Kund*in die Beratungsstunden zu buchen. Ein Link zur Onlinebuchung wird nach Vertragsunterschrift zur Verfügung gestellt. Wenn die Kund*in zu spät kommt, endet die Stunde zur gebuchten Zeit. Solange online Stunden verfügbar sind, können diese gebucht werden. Absagen und/oder Umbuchungen sind bis zu 24 Stunden vor der gebuchten Stunde möglich. Wenn die Stunde weniger als 24 Stunden vor Beginn abgesagt wird, gilt diese Stunde als genutzt. Da Notfälle Kund*innen und Beraterin passieren können, wird vereinbart, in so einer Situation so schnell wie möglich Bescheid zu sagen. Notfälle können zum Beispiel Familiennotfälle, Unfälle und Krankheiten sein.

Vertraulichkeit

Die Beratung erfolgt nach der European General Data Protection Regulation (GDPR). Die Identität der Kund*in und der Inhalt sämtlicher Kommunikation zwischen Kund*in und Beraterin sind im Rahmen der Gesetzte vertraulich zu behandeln, außer die Kund*in gibt der Beraterin die Erlaubnis spezifische Informationen weiter zu geben. Dies gilt auch im umgekehrten Fall.

Geistiges Eigentum

Alle Materialien die im Zusammenhang mit der Beratung durch die Beraterin schriftlich oder mündlich zur Verfügung gestellt wurden oder werden, sind nur für die private Nutzung der Kund*in sowie im Rahmen der Beratung. Der Inhalt der Beratung ist nur zur privaten Nutzung und darf nicht verkauft, aufgenommen, geteilt, unterrichtet, weitergegeben oder sonst wie ohne schriftliches Einverständnis der Beraterin zur Verfügung gestellt werden. Die Kund*in erkennt an, dass die Verletzung dieser Regel eine sofortige Beendigung der Beratung ohne Erstattung zur Folge hat.

Zahlung und Garantie

Der Preis wird separat festgelegt und ist im Kundenvertrag zu finden.

Rechnungen müssen innerhalb von 14 Tagen gezahlt werden. Nach 14 Tagen erfolgt eine Mahnung per E-Mail von der Beraterin. Nach 30 Tagen wird die Dienstleistung unterbrochen bis die Kund*in die Zahlungen geleistet hat.

Die Kund*in kann innerhalb von 3 Tagen nach Vertragsunterschrift von diesem zurück treten um eine volle Erstattung zu bekommen. Bearbeitungsgebühren sind nicht erstattbar. Die Kund*in kann innerhalb von 14 Tagen von der Beratung zurück treten. Wenn bis dahin bereits Beratungsstunden in Anspruch genommen wurden, können diese nicht erstattet werden.

Zahlungen sind möglich per Überweisung oder über PayPal. Mit PayPal ist ebenfalls eine Kreditkartenzahlung möglich. Alle Preise sind in Euro (€), zusätzliche Umrechnungsgebühren können anfallen. The Preise sind inklusive 19% Umsatzsteuer.

Vertragsende

Die Beratungsstunden werden als Paket verkauft. Die Beendigung oder Verlängerung der derzeitigen Vereinbarung werden in der vorletzten Beratungsstunde besprochen. Der Vertrag kann enden, wenn die Rechnungen nicht vollständig bezahlt sind. Der Vertrag kann enden, wenn sich die Kund*in respektlos gegenüber der Beraterin verhält oder die Kundenvereinbarung bricht.

Onlinekurse

Kursinhalt und Kursende

Die Beraterin stellt Informationen bezüglich Arbeitsvisumsbewerbungen im Ausland zur Verfügung. Die Informationen werden als 5-wöchiger Onlinekurs zur Verfügung gestellt und beinhalten mehrere Videos pro Woche. Die Videos werden wöchentlich per E-Mail and die Kund*in verschickt. Der Kurs steht ausschließlich online zur Verfügung. Der Vertrag beginnt mit der Zahlung durch die Kund*in und endet nachdem das letzte Modul verschickt wurde. Die Kund*in ist damit einverstanden nach Kursende kontaktiert zu werden um Feedback zu hinterlassen.

Vertraulichkeit

Geistiges Eigentum

Alle Materialien die im Zusammenhang mit dem Onlinekurs durch die Beraterin als Video oder zum Download zur Verfügung gestellt wurden oder werden, sind nur für die private Nutzung der Kund*in sowie im Rahmen des Onlinekurses. Der Inhalt des Onlinekurses ist nur zur privaten Nutzung und darf nicht verkauft, aufgenommen, geteilt, unterrichtet, weitergegeben oder sonst wie ohne schriftliches Einverständnis der Beraterin zur Verfügung gestellt werden. Die Kund*in erkennt an, dass die Verletzung dieser Regel eine sofortige Beendigung der Beratung ohne Erstattung zur Folge hat.

Zahlung und Garantie

Der Kurspreis steht auf der Internetseite des Kurses. Die Zahlung erfolgt über PayPal, es ist kein PayPal-Konto erforderlich für den Zahlungsvorgang. Mit PayPal ist ebenfalls eine Kreditkartenzahlung möglich. Alle Preise sind in Euro (€), zusätzliche Umrechnungsgebühren können anfallen. The Preise sind inklusive 19% Umsatzsteuer. Innerhalb 10 Tage nach Zahlung kann Erstattung beantragt werden. Der Zugang zu allen weiteren Kursmodulen verfällt. Wenn keine Erstattung beantragt wird, hat die Kund*in lebenslangen Zugang zum Kurs (solange der Kurs existiert), auch wenn dieser zu einer neuen Platform verschoben wird.

Kundenverantwortung

Es liegt in der Verantwortung der Kund*in die zur Verfügung gestellen Informationen zu prüfen bevor infolgedessen gehandelt wird.Die Ergebnisse der Kund*in sind unabhängig vom Kursinhalt. Wie schnell die Kund*in den eigenen Zielen näher kommt, liegt am eigenen Aufwand. Wenn aufgrund des Kurses gehandelt wird, übernimmt die Kund*in die Verantwortung für die Ergebnisse. Während die Beraterin davon überzeugt ist, dass die Kund*in großen Nutzen durch den Kurs haben, kann jedoch keine Garantie oder ein bestimmtes Level an Erfolg aufgrund dessen gegeben werden. Die Kurskosten sind eine Investition der Kund*in in ihre Veränderung. Der Kurs ist kein Ersatz für rechtlichen, steuerlichen oder finanziellen Rat.
